Residence for a child born in Spain to foreign parents
Residencia del hijo nacido en España de padres extranjeros
What it is
Minor children born in Spain to foreign parents get a temporary residence permit if either parent holds a residence permit. One parent applies in person at the Oficina de Extranjería of the province where the child lives, or through the e-office, within 6 months of the birth (or within 6 months of a parent obtaining residence, if the child is in Spain and has not left since birth). Outside those periods, the family reunification procedure applies. You submit form EX-25 signed by a parent, a copy of the full passport of the child and of the parent, a copy of the Spanish birth certificate, the parent's residence document and, if the child is of compulsory school age, proof of enrolment and the schooling declaration. Fee: form 790 code 052, section 2.1.5, within ten working days. The decision takes one month (no answer means refusal). The permit lasts five years and allows the child to work on reaching working age. Within a month of approval you must apply for the TIE at the police station, with the child accompanied by a parent.
